On Modhelm, players and teams upload evidence, for example videos and images from Roblox games. This page explains how to notify us if such content infringes your copyright, including under the US Digital Millennium Copyright Act (DMCA), and how those affected can respond.
Contents
Our own content
Texts, graphics, the logo and the software of Modhelm are protected by copyright. You may only use them as far as the law allows or we have agreed. Roblox, Discord and the names of games are trademarks of their respective owners.
Uploaded content
Users are responsible for the content they upload. We store it as a hosting service, do not check it in advance in general and show it only to the team of the respective game, not to the public. As soon as we learn of an infringement, we act promptly.
How to report an infringement
The quickest way is our notice form with the reason "Copyright or other intellectual property" or an email to info@modhelm.com. Please include:
- which work is infringed
- exactly where the content is on Modhelm (address, server and report number or another unique description)
- why the content infringes your right, and that you are the rights holder or act on their behalf
- your name and contact details
Notice under the DMCA (United States)
If you want to send a notice under 17 U.S.C. § 512(c)(3), it must contain:
- a physical or electronic signature of the authorised person
- identification of the copyrighted work
- identification of the material claimed to be infringing and information that lets us locate it
- your address, telephone number and email address
- a statement that you have a good faith belief that the use is not authorised by the copyright owner, its agent or the law
- a statement, under penalty of perjury, that the information is accurate and that you are authorised to act on behalf of the copyright owner
Send the notice to our designated agent: Marlon Güttler, c/o Realisator Media GmbH, Bayernring 7, 12101 Berlin, Deutschland, email: info@modhelm.com, subject "DMCA". The registration of our designated agent with the U.S. Copyright Office is being prepared. Until it is complete, notices reach the agent at the contact details above.
What we do then
We review every notice promptly. If it is complete and plausible, we remove or disable the content and inform the person who uploaded it and the team of the server. For notices under the DMCA, they receive a copy of the notice including the name and contact details of the notifier, so that they can respond.
Counter-notice
If your content was removed after a notice and you believe this was a mistake, you can respond. Under 17 U.S.C. § 512(g)(3) a counter-notice must contain:
- your physical or electronic signature
- identification of the removed material and where it was located before
- a statement under penalty of perjury that you have a good faith belief that the material was removed as a result of mistake or misidentification
- your name, address and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for your district or, if you live outside the United States, of any district in which we may be found, and that you will accept service of process from the notifier
We forward the counter-notice to the notifier. If they do not file a lawsuit within 10 to 14 business days, we restore the content. For responses from the EU, a reasoned email to info@modhelm.com is enough, and we review it like a complaint under the DSA.
Repeat infringers
In appropriate cases we block access to Modhelm for anyone who repeatedly infringes copyright. This also applies to servers whose team repeatedly stores infringing content.
Misuse
Anyone who knowingly makes false statements in a notice or counter-notice can be liable for the damage, in the United States for example under 17 U.S.C. § 512(f). Please check beforehand whether the use might be permitted, for example as a quotation or as evidence in a report.
